The marriage of Halle Berry and Olivier Martinez is officially over as a decree has been issued in their divorce case. The couple, who married in 2013, has agreed to share joint physical and legal custody of their 3-year-old son Maceo.
Berry and Martinez have a prenuptial agreement that governs their property rights in case of divorce. However, at this time, only the issue regarding custody of Maceo has been resolved and none of their property has yet been divided. The parties filed for divorce in October 2015 after only two years or marriage. However, nothing happened in the case for almost an entire year.
Both parties petitioned a California court for divorce at almost the exact same time in October 2015. Since only one person may be the petitioner, Olivier agreed to allow Berry to file her petition and he assumed the role of respondent.
The divorce was finalized as Berry wanted to be single by the end of 2016 because she is scheduled to earn significant income from various projects, or as her divorce docs revealed, “pending contracts and deals.” Berry claims that the negotiations for these deals were initiated a significant amount of time after the couple separated. As a result, she does not want to share any of these earnings with Martinez as community property.
