According to TMZ, the day after Mike Comrie was reported as having a drunken night out in Beverly Hills, Hilary Duff filed divorce papers. Duff cited irreconcilable differences as the reason the marriage failed and she is seeking physical custody of their two year old son, Luca. Although Duff is concerned Comrie’s partying will negatively impact their son, she has stated she is willing to give him visitation rights. The couple reportedly has a prenuptial agreement that will govern the division of assets.

Duff and Comrie have been married almost five years. They announced their separation in January of 2014, but it appears that Comrie’s wild night out on the town was the final straw. He was reportedly drinking and propositioning women. Onlookers reported that Comrie was drunk and repeatedly making passes at his waitress, who remained polite but turned him down.

When the couple announced their split, they stated that they intended to co-parent Luca and to remain friends. The actress and former NHL player stayed true to their word and were even spotted on a family vacation in Hawaii a few weeks after they split. In fact, the couple remained so close that there were continued rumors that they had reconciled.

Duff hasn’t posted about her official split from Comrie on her social media accounts, but she has been spotted bonding with her son and posted pictures of him.
