Kelly Rutherford, the Melrose Place and Gossip Girl star, has been in the news for years due to her six-year legal battle for her children. Rutherford, 46, has been fighting her ex-husband Daniel Giersch to bring their children, Hermes, 8, and Helena, 6, back to the United States.

Rutherford married Giersch in 2006. They filed for divorce in 2008 and it was finalized in July of 2010. Since then, the couple has been fighting over custody of the children and an order that allowed Giersch to keep the children in Monaco.

Rutherford has alleged that Giersch has prevented her from seeing her children. She has also claimed that he tried to have a Monaco court change their citizenship. Giersch denies these allegations and states that he has not requested any change to the children’s dual United States-German citizenship.

It has been reported that Rutherford has obtained a new court hearing date from a Monaco judge scheduled for October 26, 2015. Until that time, the couple’s children will continue to primarily live with Giersch in Monaco and France.

As for Rutherford, she recently set aside her troubles and attended the Son Jung Wan fashion show during New York Fashion Week. She is holding out hope that she will win the right to bring her children home to the U.S., where they were born.

Rutherford recently told PEOPLE that “[t]his whole time, what I’ve had to do is take an overall situation that’s so bizarre and try to keep my kids healthy. I have to keep knowing if I’m okay, they’re going to be okay. I don’t want them to be fearful. My children ask me all the time if I am still fighting for them. … I always tell them the day will never come when I say no.”
