How Is Child Support Determined?
There are a number of factors used to determine the amount of child support that will be paid to one party or the other. If there is a case where child support is at issue, a Child Support Guidelines Worksheet must be filed. These worksheets usually accompany a Family Law Financial Affidavit so as to verify the income of the party or parties filing the guidelines. Some of the factors used to determine child support are:
Net Monthly Income
Percent of Financial Responsibility
Child Care Costs
Health Insurance Costs
Uncovered Medical Expenses
Percentage of Overnight Stays with Each Parent

In some cases, child support may not necessarily be ordered based on the guidelines. If an agreement has been made between the mother and father, the parties will have to request the Court to allow a deviation from these guidelines.

Jeffrey: It is a formula, essentially. There are guidelines and we basically look at both parents’ incomes and we calculate a number based on the number of overnights that the children are with each parent. So your time-share schedule comes into play as a factor and each parents’ income or what their income could be. There are times when we have to actually impute income to a parent who many not be working at the time, but we look at what their historical earnings are or what their ability to earn is.

A woman can be ordered to pay child support if the father has majority time share of the child or if there’s a disparity in the party’s income and they’re exercising an equal or substantial time-sharing arrangement.
How is the amount of child support determined in Florida?
The amount of support is determined in Florida by using guidelines that have been prepared by the state. Really, the court just looks at your income level and the income level of your spouse, combines those two incomes in determining how much support is needed to care for the children of the parties.
